Legal Documents
One of the major roles that paralegals perform to aid attorneys is in the preparation, editing and drafting of legal documents. Contracts, deeds, legal wills and agreements need to be legal in all elements for them to be binding and enforceable to agreeing parties.
A person preparing legal instruments need to have vast knowledge on the law and statutes that are related to the agreement. This knowledge is generally achieved through a formal education and in some cases, through employer training. A paralegal can also learn from a senior paralegal or a lawyer on the job itself.
Obtaining the Necessary Knowledge
Attending trainings and courses in contract law will allow paralegals to be equipped with the necessary knowledge and develop skills needed to draw up legal documents. Through such courses, a paralegal will be able to determine the conditions that make an instrument/contract a legal agreement between two or more parties.
In some rare cases, a paralegal may also attain knowledge about contracts and other legal documents from the employer who can either be a more experienced paralegal or a lawyer. Individuals who are already fulfilling the role of paralegals or similar assistance in law firms may be enlisted to learn on the job. Such training would generally amount to a promotion to a higher level as the paralegal assumes more responsibilities.
Writing skills are also as important as knowledge on how documents should be formatted and the capability to asses whether they conform to certain statutes. This is a complementary skill, along with consideration for small detail that can help paralegals better assist lawyers.
Online Legal Documents
With the advent of the Internet, legal documents have now become more accessible online. There are websites that provide free or for-a-fee documents in general format. With this, individuals in need of certain legal papers can just download documents and personalize them to fit the agreement to be entered into.
The availability of documents online can be used as an advantage by paralegals. Those documents can act as a foundation upon which one can examine and develop into personalized and improved documents. Online documents which are also drafted by lawyers and paralegals can then act as a guide especially for paralegals who are still in the process of learning contract law.
Legal instruments or documents are binding agreements between parties and one that has to be made by a qualified individual - a lawyer or a paralegal. Knowledge about laws and statutes, writing skills and a key for detail are prerequisites to drafting qualified enforceable documents.
